Personal data is collected when you use our information offering. This is necessary for technical reasons in order to offer you all the functionalities of our website and to ensure the security of our offer (legal basis is Article 6 para. 1 sentence 1 lit. e GDPR).

The processing of your data takes place in compliance with the applicable data protection regulations. With this privacy policy, we would like to inform you about how your data is processed when you use our website and other services.

The personal data you enter will only be used for the purpose you have requested and only within the state government or the service providers, authorities, departments and institutions commissioned with the respective service. They will be deleted as soon as storage is no longer necessary for the purpose you have pursued.

Legal basis

  • Insofar as we obtain consent from the data subject for processing operations involving personal data, Article 6 paragraph 1 lit. a GDPR serves as the legal basis.
  • Where the processing of personal data is necessary for the performance of a contract to which the data subject is party, Article 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations that are necessary for carrying out pre-contractual measures.
  • Insofar as the processing of personal data is necessary for compliance with a legal obligation to which our authority is subject, Article 6(1)(c) GDPR serves as the legal basis.
  • In the event that vital interests of the data subject or another natural person require the processing of personal data, Article 6(1)(d) GDPR serves as the legal basis.
  • In the event that processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, Article 6(1)(e) GDPR in conjunction with § Section 3 DSG NRW is the legal basis.

Your rights as a user

You have the following rights with regard to the personal data concerning you:

  • the right to information in accordance with Article 15 GDPR,
  • the right to rectification pursuant to Article 16 GDPR,
  • the right to erasure pursuant to Article 17 GDPR,
  • the right to restriction of processing in accordance with Article 18 GDPR,
  • the right to object under Article 21 GDPR and
  • the right to data portability under Article 20 GDPR.

The right to information and the right to erasure are subject to the restrictions set out in sections 10 and 12 DSG NRW. 

You can withdraw your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent that were given to us before the General Data Protection Regulation came into force, i.e. before May 25, 2018. Please note that the revocation is only effective for the future. Processing that took place before the revocation is not affected by this.

Protocol or logfiles

The website of the victim protection portal is hosted by IT.NRW (so-called "processor" according to GDPR).

Each time the content of the website is accessed, data is temporarily stored there via so-called log files, which may allow identification. The following data is collected each time the website is accessed

  • Date and time of access
  • Name of the Internet service accessed, the resource accessed and the action used

This data from the log files is used to defend against and analyze attacks on the portal and is stored for up to 48 hours directly and only accessible to administrators. After that, they are only available indirectly via the reconstruction of backup tapes and are permanently deleted after six weeks.

We offer you the use of e-mail addresses to contact the Ministry. If you use this contact, the input of personal data takes place on an expressly voluntary basis (legal basis is Art. 6 para. 1 sentence 1 lit. a GDPR).

When you contact us by letter or e-mail, the data you voluntarily provide must be stored, so that we can respond to your request and process it.

Persons under the age of 16 should not transmit any personal data to us unless the consent of their parents or legal guardians (holders of parental responsibility) has been granted (Art. 8 (1) GDPR). The consent must then be expressly noted in the message (Art. 8 para. 2 GDPR). We do not request personal data from children and young people. We do not knowingly collect such data.

We will only use the personal data you provide for the purpose you have requested and only within the state government or the authorities, departments and institutions involved in the matter in question.

We delete the personal data that we receive from you by email or in writing as soon as storage is no longer required for the purpose pursued by you or in connection with the administrative processes triggered by it and the applicable retention obligations.

Disclosure of personal data

Data, logged when accessing the victim protection portal or collected for a special service will only be transmitted to third parties outside the state government

  • insofar as we are obliged to do so by law or by order of a court or public prosecutor. or by order of the public prosecutor's office or
  • if disclosure is necessary for legal or criminal prosecution in the event of attacks on the state government's Internet infrastructure.

Web analysis and statistics

For the statistical evaluation of the number of visitors to the site, the web analysis software AWStats (www.awstats.org) and Matomo (www.matomo.org). 

On the legal basis of Art. 6 para. 1 sentence 1 lit. e GDPR, the web statistics are used purely for web analysis purposes (e.g. range measurement), but not for tracking purposes. The software is operated on servers of Landesbetrieb Information und Technik Nordrhein-Westfalen (IT.NRW). 

The personal data is stored and processed anonymously. It is not merged with other data sources or passed on.
